In April, the ‘ROCKSTAR’ hitmaker was charged with felony battery by the L.A. County District Attorney’s Office for allegedly sucker-punched a man named Gary Pagar.
AceShowbiz –DaBaby needs more time. The “ROCKSTAR” hitmaker, born Jonathan Lyndale Kirk, has rushed to the court pleading for a battery lawsuit to be put on pause until the criminal case over the incident is resolved.
According to court documents obtained by Radar Online, the 30-year-old hip-hop star stated that he wants the lawsuit to be put on hold pending the resolution of the criminal complaint. His lawyer said if the case isn’t put on pause, his client will “thus not be able to respond to written discovery, answer deposition questions, or testify at trial in this case without potentially incriminating himself in the parallel criminal case.”
DaBaby’s attorney further insisted, “If, however, [DaBaby] invokes his privilege against self-incrimination in this civil case (as he plans to do), he will be unable to adequately defend himself against [Gary Pagar’s claims].”
DaBaby was sued for assault by a man named Gary Pagar. In the lawsuit, Gary explained that he owned a rental home in Runyon Canyon in Los Angeles, California that DaBaby and his team had rented out.
Gary said he learned his property was being used for a music video shoot in December 2020. The music video in question, directed by DaBaby, is allegedly Stunna 4 Vegas’s “Play U Lay” featuring Jake Paul.
DaBaby and his team allegedly agreed to have no more than 12 people on the property, as it was for a “vacation,” but when Gary arrived, 40 people were at the property to shoot a music video. The homeowner also claimed that one unknown individual attacked him while others spat on him.
Gary said DaBaby then chased him inside the property where he punched him in the face which caused one of his teeth to fall out. The alleged victim said the “BOP” emcee warned him not to call the police. “Mr. Kirk appears to think he’s a real tough guy,” the lawsuit read. “Mr. Kirk is wrong.”
DaBaby and his team reportedly fled the scene before cops arrived. Gary said his phone was stolen along with “valuable kitchenware.” Gary also claimed the home was damaged to the tune of thousands of dollars. To make matters worse, he said the “Baby on Baby” artist and his team destroyed a security camera on the property.
Then in April this year, DaBaby was charged with felony battery by the L.A. County District Attorney’s Office. After news broke that he was charged for attacking a property manager, the rapper shared a TikTok video of the alleged assault victim hurling the N-word at him as well as his crew.
In the said clip, Gary could be heard shouting, “You f**king n***a you f**king a**hole.” It was also unveiled that the man spit on DaBaby’s face during their altercation. In the caption of the post, DaBaby wrote, “Look what somebody just sent me. Y’all keep believing these Hollywood hustlers. Y’all might as well get a rope help em hang our black a** on a tree! Ima leave y’all wit that, big day in Vegas today.”
