Elon Musk has poked fun at shirtless pictures of him flaunting his bare chest while partying on a yacht in Mykonos – tweeting ‘free the nip!’ 

The world’s richest man was snapped looking very pale enjoying a drink on the boat just off the Greek island on Sunday.

The Space X founder, 51, was trying to catch some rays to get some color in his bleached skin ahead of his legal showdown with Twitter later today.

Tesla CEO Musk assured his investors that he was ‘already back in the factory’, after replying to a post on social media calling him a ‘smart’ investor.

An investor posted a picture of the Tesla CEO, writing: ‘F*** yea I got my $ behind this man. So so many other smart investors.’

Posting on Twitter, hours before the company take him to court over backing out of his $44billion takeover, Musk replied: ‘Haha damn, maybe I should take off my shirt more often … free the nip!! (already back in the factory btw).’

Elon was joined on the trip by American fashion designer Sarah who looked gorgeous in a black bikini 

He was joined by fashion designer Sarah Staudinger, 33, founder of the Staud fashion brand, and her new husband, superstar agent – and inspiration for HBO’s Entourage – Ari Emanuel, 61.

The entrepreneur has also recently been linked with Australian actress Natasha Bassett, 27, after the pair were seen dining together in St. Tropez in the South of France in May and were among the guests at Ari and Sarah’s wedding officiated by Larry David.

Later today Musk will be up in court in front of a non-nonsense judge top hear Twitters request to fast-track a trial in their lawsuit against the billionaire.

District Judge Kathaleen McCormick, the chancellor of Delaware’s Court of Chancery, has set a 90-minute hearing beginning today at 11am in Wilmington.

Musk offered the company $44million for a takeover, but backed out at the last minute after expressing concerns over the number of fake accounts and bots on the social media site.

He is yet to present any evidence to support his claims, and instead became embroiled in an online spat with current Twitter CEO Parag Agrawal.

The founder of Tesla sent a letter to Twitter saying he was pulling out of the controversial deal he made in April to buy the platform for $54.20 per share, or $44 billion in total.

Twitter has now requested a four-day trial in September in an attempt to force Musk to go through with his original bid.

The firm’s lawyers say they need just four days to prove that he should be forced to honour his agreement.

They hope that the non-jury trial could start on September 19, but legal experts have predicted the case will take two weeks to try.

McCormick has a reputation for being a no-nonsense judge who does not take prisoners but has also been hailed for the fairness of her courtroom.

Last week, Musk said he was terminating the buyout deal over concerns about bots and fake accounts.

He responded to the lawsuit with a tweet explaining that his use of the colorful emoji was shorthand for ‘BS’, a common abbreviation for ‘bulls**t.’

Twitter’s legal complaint includes the tweet from the billionaire containing the poop emoji.

The lawsuit filed on Tuesday cites Musk’s May 16 tweet, among others, as evidence that he publicly disparaged Twitter, in violation of the merger agreement, before he backed out of the deal entirely.

Musk’s tweet with the smiling poop emoji came in response to Twitter CEO Parag Agrawal, who had sent several tweets explaining the company’s procedures to combat spam and fake accounts, a battle Agrawal described as ‘dynamic.’

In another tweet on May 17, Musk appeared to encourage the SEC to investigate the accuracy of Twitter’s public disclosures.

His online posts are being presented as evidence he has been pursuing the takeover in ‘bad faith’.

But the crux of Twitter’s argument is that the world’s richest man is bound by the deal to buy the company he signed on April 25.

The lawsuit states that the deal does not include a contingency requiring Musk to secure financing.

It adds that the billionaire waived the customary right to due diligence, which refers to the type of investigation into business fundamentals that he later pursued regarding fake accounts.

The lawsuit states that Musk ‘refuses to honor his obligations to Twitter and its stockholders because the deal he signed no longer serves his personal interests’.

Musk recently welcomed a second child with Canadian pop star Grimes, real name Claire Boucher, despite splitting shortly after the birth of their daughter.

Their daughter Exa Dark Sideræl was born via a surrogate in December and they share a son X Æ A-Xii (pronounced ‘X-Ash-A-12’) who is now two.
